In spring of 2016 the Department of Labor (“DOL”) released its final rule making changes to Part 541 governing overtime exemptions under the Fair Labor Standards Act (“FLSA”) and specifically to the application of the FLSA’s “White-Collar” exemption rules.  These new regulations go into effect on December 1, 2016.

Under the new Rule, employees who are currently exempt from overtime will lose that exemption unless their salary is above the new $47,476.00 threshold.
